1. Introduction & Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and eSolutions 88, LLC, a limited liability company registered in the State of Florida, United States, with its registered address at 390 Northeast 191st Street, Miami, FL 33179, USA ("Company", "we", "us", or "our").

By accessing or using the website located at reviewcar.co.uk (the "Website") and purchasing any of our vehicle data report services (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not use the Website or purchase any reports.

We reserve the right to refuse service to anyone for any reason at any time. Your use of the Service constitutes ongoing acceptance of whatever version of these Terms is in effect at the time of use.

2. Definitions

Throughout these Terms, the following definitions apply:

  • "Service" means the online vehicle data lookup service provided through the Website, including the generation and delivery of vehicle data reports.
  • "Report" means the digital vehicle data report generated by the Service based on a submitted Vehicle Registration Number, containing information sourced from official and third-party databases.
  • "VRN" or "Vehicle Registration Number" means the alphanumeric registration mark assigned to a vehicle registered in the United Kingdom.
  • "User" means any individual or entity that accesses the Website or purchases a Report.
  • "Order" means a completed purchase transaction for a Report at any of the available service tiers.
  • "Digital Content" means data that is produced and supplied in digital form, including the Reports delivered by the Service.
  • "Third-Party Data Providers" means the external organisations and databases from which vehicle data is sourced, including but not limited to the Driver and Vehicle Licensing Agency (DVLA), the Driver and Vehicle Standards Agency (DVSA), and the UK Vehicle Data (UKVD) service.

3. Service Description

ReviewCar provides an online vehicle data lookup service that allows Users to obtain reports about vehicles registered in the United Kingdom. Upon submitting a valid UK Vehicle Registration Number and completing payment, the Service generates a Report containing data aggregated from official government agencies and authorised third-party data providers.

3.1 Service Tiers

The Service is available in three tiers, each providing different levels of detail:

  • Basic Report (£4.99) — Includes core vehicle identification data such as make, model, colour, year of manufacture, engine size, fuel type, tax status, MOT status, and MOT expiry date. This tier is suitable for quick verification of a vehicle's essential details.
  • Full Report (£9.99) — Includes everything in the Basic Report plus comprehensive MOT history (including advisory notices, failure reasons, and mileage readings at each test), detailed tax history, V5C logbook change dates, and vehicle specification data such as CO2 emissions, weight, and dimensions.
  • Premium Report (£14.99) — Includes everything in the Full Report plus enhanced checks such as outstanding finance checks, write-off and insurance total loss records, stolen vehicle markers, import/export status, plate change history, and a Vehicle Identity Check (VIC) summary where available.

3.2 Data Sources

Reports are compiled using data sourced from the DVLA, DVSA, UKVD, and other authorised data providers. The availability and completeness of data may vary depending on the vehicle's history and the records held by these providers.

4. Pricing & Payment

4.1 Pricing

All prices are displayed in British Pounds Sterling (GBP) and are inclusive of any applicable taxes. The current prices for each service tier are:

  • Basic Report: £4.99 (one-time payment)
  • Full Report: £9.99 (one-time payment)
  • Premium Report: £14.99 (one-time payment)

These are one-time, non-recurring charges. There are no subscriptions, hidden fees, or automatic renewals. You will only be charged for the specific Report you choose to purchase.

4.2 Payment Processing

All payments are processed securely through Stripe, our third-party payment processor. We do not store, process, or have access to your full credit or debit card details. All payment data is handled directly by Stripe in accordance with the Payment Card Industry Data Security Standard (PCI DSS). By making a purchase, you also agree to Stripe's Terms of Service.

4.3 Currency

All transactions are charged in GBP. If your payment method is denominated in a different currency, your card issuer or bank may apply a currency conversion fee, which is outside our control.

4.4 Refund Policy

Because our Reports constitute digital content that is delivered instantly upon purchase, you acknowledge and agree that you lose your statutory right to a 14-day cooling-off period under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 once the Report has been generated and delivered. By completing a purchase, you expressly consent to the immediate delivery of the digital content and acknowledge the loss of your cancellation right.

Notwithstanding the above, we will consider refund requests on a case-by-case basis where:

  • A Report could not be generated due to a technical error on our part.
  • The VRN entered was valid but no data was returned from any data provider.
  • You were charged more than once for the same Report due to a payment processing error.

5. Delivery

5.1 Instant Delivery

Reports are digital goods and are delivered instantly upon successful payment. Once your payment is confirmed by Stripe, your Report is generated in real time and displayed immediately on screen within the Website.

5.2 Email Delivery

A copy of your Report is also sent to the email address you provide at the time of purchase. Email delivery typically occurs within a few minutes of purchase, though delivery times may vary depending on your email provider. It is your responsibility to ensure the email address provided is accurate.

5.3 Report Access

You may access your purchased Report via the Website for a period of 30 days from the date of purchase. After this period, the Report may no longer be available for online viewing. We recommend saving or printing your Report for your records.

6. Data Accuracy Disclaimer

The information contained in our Reports is sourced from third-party data providers, including but not limited to the DVLA, DVSA, and UKVD. While we make reasonable efforts to ensure the accuracy and completeness of the data presented, we do not warrant or guarantee that the information in any Report is accurate, complete, current, or error-free.

Reports are provided on an "as is" and "as available" basis. The data reflects what is held in third-party databases at the time of the query and may be subject to delays, errors, or omissions in those source databases that are beyond our control.

Our Reports are intended to be used as one source of information among several when making decisions about a vehicle. They are not a substitute for a physical vehicle inspection, a professional mechanical assessment, or an HPI check. We strongly recommend that Users carry out their own independent due diligence before making any purchasing decisions based on Report data.

We accept no liability for any decisions made, losses incurred, or actions taken in reliance upon information contained in our Reports.

7. Acceptable Use

By using the Service, you agree to the following:

  • You will only use the Service for lawful purposes and in accordance with these Terms.
  • You will only submit VRNs for vehicles that you have a legitimate reason to enquire about (for example, because you are considering purchasing the vehicle, you are the registered keeper, or you have another lawful basis).
  • You will not use the Service to harass, stalk, or track any individual.
  • You will not use any automated means (including scripts, bots, scrapers, or spiders) to access the Service, submit queries, or extract data.
  • You will not attempt to reverse-engineer, decompile, or otherwise extract the source code of the Website or Service.
  • You will not resell, redistribute, or commercially exploit Reports or their contents without our prior written consent.
  • You will not use the Service in any way that could damage, disable, overburden, or impair the Website or interfere with any other party's use of the Service.
  • You will not submit false, misleading, or fraudulent information.

We reserve the right to suspend or terminate access to the Service for any User who violates these acceptable use provisions, without prior notice or refund.

8. Intellectual Property

8.1 Our Intellectual Property

The Website, its design, layout, look, appearance, graphics, logos, trademarks, and all software, text, and other content (collectively "Our Content") are owned by or licensed to eSolutions 88, LLC and are protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, display, or create derivative works from Our Content without our express written permission.

8.2 Report Licence

Upon purchasing a Report, you are granted a limited, non-exclusive, non-transferable, revocable licence to access and use that Report for your personal, non-commercial purposes only. This licence does not transfer any ownership of the Report or its contents to you. You may not sell, licence, share publicly, or distribute the Report to third parties for commercial purposes.

8.3 Third-Party Data

Data contained within Reports originates from third-party data providers and remains subject to the intellectual property rights and terms of those providers. Crown copyright data sourced from DVLA and DVSA is used under the terms of the Open Government Licence where applicable.

9. Limitation of Liability

9.1 Exclusion of Warranties

To the maximum extent permitted by law, we exclude all warranties, conditions, and representations, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9.2 Limitation of Liability

To the maximum extent permitted by applicable law:

  • Our total aggregate liability to you for any claim arising out of or in connection with these Terms or the Service shall not exceed the amount you paid for the specific Report giving rise to the claim.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business opportunity, or loss of goodwill, whether or not we were advised of the possibility of such damages.
  • We shall not be liable for any loss or damage arising from the inaccuracy, incompleteness, or unavailability of data provided by third-party data sources.
  • We shall not be liable for any failure or delay in providing the Service caused by circumstances beyond our reasonable control, including but not limited to outages of third-party data provider systems, internet connectivity issues, or force majeure events.

9.3 Consumer Rights

Nothing in these Terms is intended to exclude or limit any rights you may have under the Consumer Rights Act 2015 or any other mandatory consumer protection legislation that cannot be excluded or limited by contract. If you are a consumer, your statutory rights remain unaffected.

10. Governing Law & Jurisdiction

10.1 UK Consumer Matters

If you are a consumer based in the United Kingdom, these Terms and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. You and we both agree to submit to the non-exclusive jurisdiction of the courts of England and Wales, although if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland you may also bring proceedings in Scotland.

10.2 Entity & Corporate Matters

For all matters relating to the corporate governance, formation, and internal affairs of eSolutions 88, LLC as a legal entity, the laws of the State of Florida, United States shall apply. Any disputes relating to such matters shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida.

10.3 Dispute Resolution

11. Changes to These Terms

We reserve the right to update or modify these Terms at any time at our sole discretion. When we make material changes, we will:

  • Where reasonably practicable, provide notice of material changes via the Website or by email to Users who have previously made a purchase.

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service. Changes will not apply retrospectively to Orders already completed before the date of the change.
